NibaChat Agent is a SaaS platform that helps businesses automate and manage customer conversations using AI-assisted replies, business knowledge bases, product catalogs, Facebook/Instagram integrations, Telegram notifications, and related tools.

2. Eligibility

You may use NibaChat Agent only if you are legally able to enter into a binding agreement and use the service in compliance with applicable laws.

If you use NibaChat Agent on behalf of a business, you confirm that you are authorized to bind that business to these Terms.

3. Accounts

You are responsible for:

• maintaining the confidentiality of your login credentials
• all activity under your account
• ensuring your business information is accurate
• limiting access to authorized users only

You must notify us if you suspect unauthorized access.

4. Business Data

You retain ownership of the business data you upload or connect to NibaChat Agent, including products, FAQs, policies, website content, and customer conversation data.

You grant us the limited right to process this data only as needed to provide and improve the service.

5. Customer Messages and AI Responses

NibaChat Agent may generate AI-assisted replies based on your business settings, products, and knowledge base.

You are responsible for:

• reviewing your bot configuration
• ensuring your policies and product data are accurate
• monitoring AI replies where appropriate
• handling customer support, refunds, complaints, and legal obligations

AI-generated output may be inaccurate or incomplete. You should not rely on it for legal, medical, financial, or other high-risk decisions.

6. Integrations

NibaChat Agent may integrate with third-party services, including Meta platforms, Telegram, OpenAI, and other providers.

Your use of these integrations may also be subject to the third party’s terms and policies.

We are not responsible for outages, API changes, restrictions, or actions by third-party platforms.

7. Acceptable Use

You agree not to use NibaChat Agent to:

• violate laws or regulations
• send spam or unauthorized messages
• impersonate others
• mislead customers
• collect sensitive data without proper authorization
• upload illegal or harmful content
• interfere with the security or operation of the service
• reverse engineer or abuse the platform

8. Payments and Plans

If paid plans are offered, billing terms, pricing, limits, and renewal details will be shown at the time of purchase or in your account.

Failure to pay may result in suspension or termination of access.

9. Suspension and Termination

We may suspend or terminate access if:

• you violate these Terms
• your use creates risk to the platform or other users
• required third-party access is revoked
• payment is not made where applicable
• we are required to do so by law or platform rules

You may stop using the service at any time.

Some data may be retained where required for security, legal compliance, dispute resolution, or legitimate business records.

11. Service Availability

We aim to provide reliable service, but we do not guarantee uninterrupted access. The service may be unavailable due to maintenance, outages, third-party API issues, or other causes.

12. Disclaimer

NibaChat Agent is provided “as is” and “as available”. To the maximum extent permitted by law, we disclaim warranties of merchantability, fitness for a particular purpose, and non-infringement.

13. Limitation of Liability

To the maximum extent permitted by law, NibaChat Agent and its operators will not be liable for indirect, incidental, special, consequential, or punitive damages, or for loss of profits, revenue, data, goodwill, or business opportunities.

14. Changes to the Service or Terms

We may update the service or these Terms from time to time. Updated Terms will be posted on this page with a new “Last updated” date.

15. Governing Law

These Terms are governed by the laws of the United States, unless mandatory local law requires otherwise.
